Time Bar means the following:

Time Bar means the period in which a claim, once reported to the Terminal Operator, must be finally decided upon in terms of the Terminal Operator's internal claims procedures, which time bar period is a period of 420 (four hundred and twenty) days from the time that the Customer places the Terminal Operator on notice in respect of a damages claim.

  • Such notice of an Indemnification Claim shall be provided promptly after knowledge of such claim, provided the failure to provide such prompt notice shall not relieve the indemnifying party of its obligations under this Section 5.03(a) other than to the extent that the indemnified party is actually prejudiced and no claim shall be made after the applicable Time Bar.
