Third Party Incident definition

Third Party Incident means the sharing by a third party of Respondents’ Location Data, in violation of a contractual requirement between Respondents and the third party.
Third Party Incident means any instance in which a third party is or may be responsible or liable for paying all or part of the expenses for which a claim is filed with the Plan.
Third Party Incident means the release of a Hazardous Substance(s) caused in whole or in part by the act or omission of someone other than the Concessionaire, or any of the Concessionaire’s Advisors, Designated Consultants, employees, agents, contractors, servants, successors or assigns, or a party for whom the Concessionaire is in law responsible. The parties acknowledge that Third Party Incident includes the release of a Hazardous Substance caused in whole or in part by the act or omission of an arm’s length road user of the Industrial Concession Highway where such road user is not one of the Concessionaire’s Advisors, Designated Consultants, employees, agents, contractors, servants, successors or assigns.
