Nothing in this Agreement shall limit or exclude ▇▇▇▇▇▇ ▇▇▇ Ltd.’s of the Restaurant’s liability for death or personal injury caused by its negligence, or the negligence of its employees, agents or subcontractors; fraud or fraudulent misrepresentation; breach of the terms implied by section 2 of the Supply of Goods and Services act 1982 (title and quiet possession); or any other liability that cannot be limited or excluded under applicable law.
Neither Party excludes or limits it liability for: death or personal injury caused by its negligence, or that of its employees, agents or Sub-Contractors (as applicable); bribery or Fraud by it or its employees; breach of any obligation as to title implied by section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982; or any liability to the extent it cannot be excluded or limited by Law.
In some contracts -for example in the Supply Contract- the date of coming into force is also mentioned in one of the clauses.
The Supplier warrants that neither the Supplier nor any of its Subcontractors, or any of their respective directors, officers, employees or agents, has any predisposition, affinity or association with any third party which would impair or be seen to impair or qualify the Supplier’s provision of the Supply.
Records of these meetings shall be submitted to the Supply Manager by the person convening the meeting within five days of the meeting.
