The Franchisee shall regularly monitor the amount of Franchise Garbage from each Customer, and, unless the Customer specifically requests otherwise, shall only provide that level of service, which the Customer is entitled to receive as a result of its classification.
The Commercial Customer may choose the size of the Container(s) for Franchise Garbage, Recyclables, and Organics based on the options listed in the Commercial Service Schedule in Appendix B-2; provided, however, that unless otherwise exempted by the City, all Commercial Customers shall be provided a minimum of one (1) 64-gallon Recyclables Cart and one (1) 64-gallon Organics Cart and charged for 1x/week collection at the then-current rates provided in Appendix B-2.
Except for Uncontrollable Circumstances and where City fails to secure capacity for any Franchise Materials pursuant to the provisions of Section 2.1.G, the failure by the Franchisee for any reason, without any requirement of notice or cure opportunity, to deliver to the Designated Disposal Site, on a consecutive or cumulative basis though out the Term of this Franchise, Garbage that it collects from Customers in any significant amount.
The Franchisee, without constraint and as a free market business decision in accepting this Franchise, agrees to use the Designated Disposal Site for disposal of Franchise Garbage, the Designated Composting Facility for Organics Processing, and the Designated C&D Processing Facility for C&D Processing.
