Termination and Assignment. At any time prior to the parties agreeing on the Estimate of Construction Cost (in Phase II of the Agreement) the Owner may elect not to proceed further under this agreement. Such an election must be given in writing. If requested by the Owner, KDA agrees to assign its contractual agreement with the Architect to the Owner to provide Architectural and Engineering Services for the project.
