At the Port’s discretion in consultation with Tenant, the Port shall also have the ability to deviate from charges set forth in the Port’s Terminal Tariff Number 4 and Number 5 for specific customers and/or transactions.
All amounts billed for dockage, wharfage, passenger fees, fresh water and other terminal fees shall be as set forth in the Port’s Terminal Tariff Number 4 and Number 5, as applicable (and as amended from time to time), unless otherwise agreed by the Port in writing.
