If the Final Settlement Order and Judgment or any part of it is vacated, overturned, reversed, or rendered void as a result of an appeal, or the Settlement Agreement is voided, rescinded, or otherwise terminated for any other reason, Class Counsel shall within thirty (30) days repay to Termax, based upon written instructions provided by Termax’s Counsel, the full amount of the attorneys’ fees and costs paid to Class Counsel from the Settlement Fund, including any accrued interest.
If a claimant is not included in the Class List, then the Settlement Administrator shall immediately forward the claim to Termax, through Defendant’s Counsel, to conduct a reasonable investigation to help determine whether the claim is valid.
To the extent Termax does not have last-known U.S. Mail addresses for Persons within the Settlement Class, it will undertake good-faith efforts to obtain that information, including, if necessary, by cooperating with Class Counsel’s efforts to attempt to subpoena that information from any applicable non-parties.
