Tenable means: (i) Tenable, Inc., if Customer is a commercial entity or individual located in North or South America (Tenable, Inc. is a Delaware corporation having offices at 6100 ▇▇▇▇▇▇▇▇▇▇▇▇ Drive, 12th Floor, Columbia, MD 21044); (ii) Tenable Public Sector LLC, if Customer is an agency or instrumentality of the United States Government, a commercial entity operating predominantly as a federal systems integrator for eventual sale or resale or for the benefit of the United States Government, or an agency or instrumentality of a State or local government within the United States (Tenable Public Sector LLC is a Delaware limited liability company having offices at 6100 ▇▇▇▇▇▇▇▇▇▇▇▇ Drive, 12th Floor, Columbia, MD 21044); or (iii) Tenable Network Security Ireland Limited, if Customer is located outside of North or South America (Tenable Network Security Ireland Limited is a private limited company having offices at 81b Campshires, ▇▇▇ ▇▇▇▇ ▇▇▇▇▇▇▇▇’s Quay, ▇▇▇▇▇▇ ▇, ▇▇▇▇▇▇▇).

  • Notwithstanding the foregoing, Tenable will be solely responsible for its income tax obligations and all employer reporting and payment obligations with respect to its personnel.

  • If Tenable is unable to restore such functionality within sixty (60) days, Customer shall be entitled to terminate the Agreement and receive a pro-rata refund of any prepaid but unused fees for the nonconforming Hosted Services.

  • Customer understands and acknowledges that the Scans may originate or appear to originate from a Tenable URL which could cause Customer (or the owner of the Scan Targets) to believe they are under attack.

  • Such plan shall provide for separate access gates to the Project and separate parking for Owner’s administrative, operations and/or maintenance personnel, and other Personnel entering the Project Site in connection with the business operations Owner and/or operations and maintenance of the Project.
