Grantor has executed this Grant of Temporary Easement on the date shown in the acknowledgment set forth below to be effective as of the Effective Date.
In the event that the NYPSC approves the Easement Agreement but not the transfer of the Con Edison Equipment and associated accounting and rate treatment, Central ▇▇▇▇▇▇ will be provided by Con Edison with a permanent easement for the Temporary Easement Area corresponding to that for the Easement Area, at nominal consideration for the equipment, and will continue to own the equipment.

The meter shall be located on the Temporary Easement Area at a location approved by Con Edison and Con Edison shall own and read the meter.
Con Edison forces will also perform all acceptance/commissioning tests associated with the installation inside the East Fishkill substation and the Temporary Easement Area excluding the circuit breaker on the Easement Area.
TOGETHER WITH easements contained or conveyed in that certain Temporary Easement Agreement by and between BR-TBR W▇▇▇▇▇▇▇▇ Owner, LLC, TriBridge Residential, LLC, University Ford, Inc., and University Properties of N.C., L.L.C. being recorded in Durham County Registry prior to the Deed of Trust from BR-TBR W▇▇▇▇▇▇▇▇ Owner, LLC to KeyBank National Association.
TOGETHER WITH the easement rights created in the following: Temporary Easement and Right of Way as set forth in a deed dated December 30, 2003 and recorded in Volume 5261 at Page 205.
