PROVIDED THE NETWORK HAS PROPERLY INSTALLED, CONFIGURED, TESTED, SECURED, AND MAINTAINED THE SERVICES, THE NETWORK SHALL HAVE NO RESPONSIBILITY FOR OR LIABILITY RELATED TO THE ACCURACY, CONTENT, CURRENCY, COMPLETENESS, OR DELIVERY OF ANY MESSAGE CONTENT PROVIDED BY A TDSO TO THE SERVICES.
During this meeting, each TDSO will be able to present its version of the Dispute and any information that it believes is pertinent to the Dispute Resolution Subcommittee’s decision.

The execution of this DURSA by NJII, acting on behalf of NJDOH, and the TDSO will signify that the TDSO has satisfied the standards and done everything that is required by NJDOH for the TDSO to connect to the NJHIN.
Information provided by TDSO to NJII in accordance with this Section 8, except Message Content, may be considered “Confidential Party Information.” Such “Confidential Party Information” as defined in Exhibit A.
The temporary suspension notice shall be submitted to the offending TDSO no later than five (5) business days after initiation of the temporary suspension.
If, following the conclusion of the Dispute Resolution Process in accordance with this Section 15, TDSO and/or any other essential, interested and/or “affected” person or party to the matter contends that the progressive Dispute Resolution Process has failed adequately to resolve the Dispute, such person or party may pursue any remedies that are or may be available to it in a Court of competent jurisdiction.
In the normal course of operations, TDSO will allow its Users to submit Messages that seek Message Content for Treatment, Payment and/or Healthcare Operations and shall exchange Message Content with other Users for Treatment, Payment and/or Healthcare Operations in accordance with this Agreement consistent with the standards for health information exchange in applicable Federal and state law.
Nothing in this Section 19.12 prevents a TDSO from terminating this Agreement in accordance with Section 4.2 during a force majeure event.
