TARRANT means Tarrant Apparel Group, a California corporation, and the sole shareholder of TAG MEX.
TARRANT lies to the east, “Brokera” some miles to the west, “Bundella” some miles further to the west with “Troutbeck” adjoining it. Clause 3 fixed the purchase money at $25,000; this amount by Clause 18 was apportioned as to $18,500 to cattle and as to the balance to the leases, plant and fencing. Clause 4 provided for a deposit of $2,500 and for payment of the balance on settlement. Clause 5 was as follows: “Delivery and legal possession of the said pastoral holding and all the property sold and purchased as aforesaid shall be given and taken on the date of settlement which shall be a date twenty eight (28) days from the date on which 250 head of cattle of at least three (3) years old or such lesser number as the purchaser may agree to in writing are rounded up in the presence of a representative of the purchaser and if so desired by the Purchaser taken from the said property and sold by the purchaser. On the date of settlement the purchaser's authorised agent shall be at one of the said pastoral holdings to take delivery and delivery and legal possession shall then be given to him.” Clause 9 was as follows: “This Contract and Sale are subject to 250 cattle at least three (3) years old or such lesser amount as the purchaser may agree to in writing being rounded up in the presence of a representative of the purchaser and if so required by the purchaser taken from the said property and sold within twelve (12)...
