System Control Software definition

System Control Software means software capable of accessing, monitoring and/or controlling one or more Nodes and/or Gateways in a Network. However, System Control Software shall not include any firmware or software that is integrated or intended for integration into Nodes and/or Gateways, or any components thereof.

  • For clarification, the royalties set forth in this Section 3.1 are additive to the extent that Devices, System Control Software and/or Remote Access Services are Sold separately.

  • Profound Technologies hereby grants to Customer a worldwide, perpetual, non- exclusive, non-transferable license to all System Control Software for Customer’s use in connection with the establishment, use, maintenance, service and modification of the system implemented by Profound Technologies.

  • In no way does the foregoing System Control Software License confer any right to Customer to license, sublicense, sell, or otherwise authorize the use of the System Control Software, whether in executable form, source code, object code, or otherwise, by any third parties, except in connection with the use of the system as part of Customer’s ordinary course of business and only when such use is previously disclosed to and specifically approved by OhmComm, Inc..

  • OhmComm, Inc.’ makes no warranty or representation that the System Control Software will be bug or error free, or that use of the System Control Software will achieve any particular result(s), except as may be stipulated in the published specifications included within the documentation.
