The Synchronization Test will demonstrate that the plant is capable of automatic synchronization to the power transmission lines, and has reached the point where it is capable of delivering power to the grid.
In the event that any dispute among the parties --------------- to this Warrant should result in litigation, the prevailing party in such dispute will be entitled to recover from the losing party all fees, costs and expenses of enforcing any right of such prevailing party under or with respect to this Agreement including, without limitation, reasonable fees and expenses of attorneys and accountants, which will include, without limitation, all fees, costs and expenses of appeals.
If the grid is unavailable for the Synchronization Test through no fault of the Contractor, the test will be deemed complete on the date that the plant is deemed ready to be synchronized, including all purging of pentane lines and other pre-startup activities.
The Synchronization Test shall be considered successful if the test is conducted without any equipment malfunction and the plant is deemed ready for further testing per this Exhibit D.
