A Survey Affidavit is required in order to qualify for this rate.
The Record of Survey shall be filed together with the deed(s) and Record of Survey Affidavit (See Appendix F).
Each such survey shall be accompanied by an affidavit (a "Survey Affidavit") of an authorized signatory of the owner of such property stating that there have been no improvements or encroachments to the property since the date of the respective survey such that the existing survey is no longer accurate.
To the extent necessary to permit the issuance of title insurance without exception for matters of survey, such survey shall be accompanied by an affidavit (a "Survey Affidavit") of the Management Company, on behalf of the Borrower, in form and substance satisfactory to the Administrative Agent.

The representations set forth in that certain Survey Affidavit and Indemnity executed by Xxxxxxxx for the benefit of Commonwealth Land Title Insurance Company on or about the date hereof are true and correct.
A Survey of the Land, with current Survey Affidavit (and any existing improvements thereon) and Surveyor's Certificate, and evidence of payment of all real estate taxes and municipal charges on the Land (and any existing improvements thereon) which were due and payable prior to the Closing Date.
Seller shall execute and deliver to Purchaser and/or the Title Company, as applicable, such Title Affidavits (including, without limitation, an Owner’s Affidavit and (No Change) Survey Affidavit) in customary form to enable the Title Company to issue an Owner’s policy of title insurance to Purchaser (subject only to the Permitted Exceptions) and all endorsements thereto as are requested by Purchaser.
To the extent that any such survey was not prepared within the sixty (60) day period immediately preceding the Closing Date, such survey shall be accompanied by an affidavit (a "Survey Affidavit") of an authorized signatory of the owner of such property stating that there have been no improvements or encroachments to the property since the date of the respective survey such that the existing survey is no longer accurate.
Notwithstanding the foregoing, Xxxxx will accept current As-built Survey’s in Seller’s possession provided: (i) Title Company is willing to accept from Seller “A Survey Affidavit in lieu of Updated Survey” (“Survey Affidavit”) and; (ii) Title Company is willing to provide survey coverage to Buyer upon receipt of the Survey Affidavit from Seller.
