Survey Affidavit definition

Survey Affidavit shall have the meaning assigned thereto in Section 4.2(c)(viii).
Survey Affidavit has the meaning specified in Section 6.02.

Examples of Survey Affidavit in a sentence

  • The HUD Closing Attorney may accept an Owner’s Survey Affidavit certifying to no material change, in a format similar to that attached hereto in Closing Guide Part 5 to document the lack of changes.

  • The Record of Survey shall be filed together with the deed(s) and Record of Survey Affidavit (See Appendix F).

  • A Survey Affidavit is required in order to qualify for this rate.

  • Each such survey shall be accompanied by an affidavit (a "Survey Affidavit") of an authorized signatory of the owner of such property stating that there have been no improvements or encroachments to the property since the date of the respective survey such that the existing survey is no longer accurate.

  • Borrower must provide the Survey Affidavit of No Change and a legible copy of the attested survey from the most recent HUD transaction where a survey was required.

  • A Survey of the Land, with current Survey Affidavit (and any existing improvements thereon) and Surveyor's Certificate, and evidence of payment of all real estate taxes and municipal charges on the Land (and any existing improvements thereon) which were due and payable prior to the Closing Date.

  • The Survey Affidavit of No Change is only applicable in 223(a)(7) refinancing transactions where there has been no material change (i.e., no new construction has taken place, no changes have been made to the land, buildings, or improvements, no new easements that can be plotted on a Survey) since the most recent HUD transaction in which a Survey Plat was required.

  • In such cases, the borrower must provide the Survey Affidavit of No Change and a legible copy of the attested survey.

  • Transfer Affidavit As defined in Section 5.02(c).

  • FIRPTA Affidavit means the Foreign Investment in Real Property Tax Act Certification and Affidavit, substantially in the form of Exhibit D hereto.

  • Transferee Affidavit As defined in Section 5.03(n).

  • Affidavit means the affidavit certifying eligibility under section 29A of IBC provided by the Bidder substantially in form and manner as set out in Annexure 3 of this Process Memorandum;

  • Lost Note Affidavit With respect to any Mortgage Loan as to which the original Mortgage Note has been permanently lost or destroyed and has not been replaced, an affidavit from the Seller certifying that the original Mortgage Note has been lost, misplaced or destroyed (together with a copy of the related Mortgage Note and indemnifying the Trust against any loss, cost or liability resulting from the failure to deliver the original Mortgage Note) in the form of Exhibit H hereto.

  • Survey Report means a report of the results of a Survey, containing the information set out in clause 12.4 and Schedule 6.

  • Record of survey map means a map of a survey of land prepared in accordance with Section 10-9a-603, 17-23-17, 17-27a-603, or 57-8-13.

  • Survey Area means the area of land or waters the subject of a Survey, or proposed to be the subject of a Survey.

  • Survey means a survey of the Property prepared by a surveyor licensed in the State and satisfactory to Lender and the company or companies issuing the Title Insurance Policy, and containing a certification of such surveyor satisfactory to Lender.

  • Transfer Affidavit and Agreement As defined in Section 5.02(d).

  • Transferee Affidavit and Agreement As defined in Section 6.02(g)(i)(B).

  • Land surveyor means the land surveyor appointed by the Seller, to act as such from time to time in respect of the Development or a member of a firm so appointed.

  • Estoppel Certificate As defined in Section 23.1(a).

  • Surveyor means a professional surveyor licensed under article 20 of the occupational code, 1980 PA 299, MCL 339.2001 to 339.2014.

  • Title Report has the meaning set forth in Section 5.4(b).

  • Professional land surveyor means a professional land surveyor licensed under ch. 443.

  • Estoppel Letter A document executed by the Cooperative Corporation certifying, with respect to a Cooperative Unit, (i) the appurtenant Proprietary Lease will be in full force and effect as of the date of issuance thereof, (ii) the related stock certificate was registered in the Mortgagor's name and the Cooperative Corporation has not been notified of any lien upon, pledge of, levy of execution on or disposition of such stock certificate, and (iii) the Mortgagor is not in default under the appurtenant Proprietary Lease and all charges due the Cooperative Corporation have been paid.

  • Assistant Hydrographic Surveyor means the Assistant Hydrographic Surveyor of the Authority, as the case may be

  • FIRPTA Certificate an affidavit from the Annual Conference pursuant to Section 1445(b)(2) of the Code in the form attached hereto as Exhibit D, and on which Buyer is entitled to rely, that Seller is not a “foreign person” within the meaning of Section 1445(f)(3) of the Code

  • Responsive and Responsible Bidder means an entity or individual that has submitted a bid that conforms in all material respects to the Invitation to Bid and has the capability in all respects to fully perform the contract requirements and the integrity and reliability that will assure good faith performance. “Responsive and Responsible Vendor” means an entity or individual that has submitted a proposal, reply, or response that conforms in all material respects to the Request for Proposals, Invitation to Negotiate, or Competitive Solicitation and has the capability in all respects to fully perform the contract requirements and the integrity and reliability that will assure good faith performance. In determining whether an entity or individual is a Responsive and Responsible Bidder (or Vendor), the District may consider, in addition to factors described in the Invitation to Bid, Request for Proposals, Invitation to Negotiate, or Competitive Solicitation, the following:

  • Disclosure Certificate means this Continuing Disclosure Certificate.

  • FIRPTA means the Foreign Investment in Real Property Tax Act of 1980, as amended.

  • Affidavit of Small Business Enterprise Certification means the fully completed, signed, and notarized affidavit that must be submitted with an application for SBE certification. Representations and certifications made by the applicant in this Affidavit are made under penalty of perjury and will be used and relied upon by City to verify SBE eligibility and compliance with SBE certification and documentation requirements.

  • Request for Release A release signed by a Servicing Officer, in the form of Exhibit E attached hereto.

  • ALTA means American Land Title Association, or any successor thereto.

  • Interim Certification As defined in Section 2.02.
