Surrender Claims definition
Surrender Claims means claims to the extent the same arise solely out of the failure of Tenant to surrender the Premises in the condition required by Paragraph 52 or to maintain and repair the Premises as required by Paragraph 11. Surrender Claims do not include, inter alia, claims arising under or pursuant to Paragraph 10. The foregoing provisions of this Paragraph shall not apply in the event this Lease is terminated by Landlord as a result of an Event of Default by Tenant.

Any "Surrender Claims" (as hereinafter defined) by Landlord must be presented in writing by Landlord to Tenant within one hundred twenty (120) days after expiration or termination of this Lease or shall be deemed irrevocably waived.
