Delete this clause if not required] If the Council proposes to impose a condition under s94 of the Act in respect of any future development proposed to be carried out by the Developer within the Council’s area, the Council may, to the extent permitted by law, take into consideration whether an allowance should be made for the Surplus Value (if any) in determining the extent of the Developer’s obligation to make a Development Contribution under such a condition.
