These Support and Availability Commitment Terms (these "Terms") outline the commitment for delivery of services to Customers that use eLabNext Software pursuant to the terms of the Agreement.
Notwithstanding anything to the contrary herein or in the applicable Agreement, these Support and Availability Commitment terms shall terminate upon expiration or termination of the order or expiration or termination of Your right to access eLabNext Software products through the expiry of Your Software License or Software Maintenance Plan for a Perpetual License.
Upon execution of the contract and delivery/activation of the PTV Product, the cooperation enters into the phase of Maintenance, Support and Availability Services ("MSAS"), which encompasses three aspects: • Continuous Updates of the PTV Product (section 2); • Product Support provided by PTV, pertaining to the usage of the PTV Product and the product-specific functionalities (section 3); • 24/7 Service Availability of the PTV Product hosted by PTV in the Cloud (section 4).
Contrast will provide support and uptime for the Service and/or Product, as applicable, in accordance with (i) the support package selected by Customer on the applicable Order Form (if any), and (ii) Contrast’s then-current standard Support and Availability Policy set forth at ▇▇▇.▇▇▇▇▇▇▇▇▇▇▇▇▇▇▇▇.▇▇▇/▇▇▇.
Maintenance, Support and Availability Services (“MSAS”) have the meaning provided in the introduction of this SLA.

Contrast is not under any obligation to provide support to You if you are accessing the Services pursuant to a free offering or pursuant to an evaluation and Contrast’s Support and Availability Policy shall not apply to Your access and use.
