Supplier COTS Software. Supplier Software (including open source software) that: (a) the Supplier makes generally available commercially prior to the date of this Agreement (whether by way of sale, lease or licence) on standard terms which are not typically negotiated by the Supplier save as to price; and (b) has a Non-trivial Customer Base;

Examples of Supplier COTS Software in a sentence
The Supplier shall not use any Supplier COTS Software in the provision of the Services which cannot be licensed in accordance with Paragraph 2.4(b) unless approval is granted by the Authority following a review by the Technical Design Authority.
Document Set shall include provisions for major version upgrades of all Supplier COTS Software and Third Party COTS Software to be kept up to date such that all Supplier COTS Software and Third Party COTS Software are always in mainstream support throughout the Term unless otherwise agreed by the Authority in writing.
