The Servicer shall not be required to satisfy the indebtedness secured by any Superior Liens on the related Mortgaged Property or to advance funds to keep the indebtedness secured by such Superior Liens current.

The Servicer shall give the Indenture Trustee notice of the election of remedies made pursuant to this Section 4.2. The Servicer shall not be required to satisfy the indebtedness secured by any Superior Liens on the related Mortgaged Property or to advance funds to keep the indebtedness secured by such Superior Liens current.
Except for the security interest granted to the Administrative Agent for the ratable benefit of the Secured Parties pursuant to this Agreement, the Permitted Expenses and the Superior Liens, such Grantor owns each item of the Collateral free and clear of any and all Liens or claims of others.

No effective financing statement or other public notice with respect to all or any part of the Collateral is on file or of record in any public office, except such as have been filed (i) in favor of the Administrative Agent, for the benefit of the Secured Parties pursuant to this Agreement or (ii) pursuant to the Superior Liens.
