Summer Availability definition

Summer Availability shall have the meaning set forth in Section 8.05 hereof. “Summer Period” means, in any year during the Term, the period which includes all hours of June, July, August and September of any year during the Term (or if only a portion of such months falls within the Term, then the period which includes all the hours of such months which falls within the Term).

Summer Availability means, in respect of any Summer Period, a fraction, the numerator of which shall be the number of hours during which the Facility is Available during such Summer Period, and the denominator of which is the total number of hours in such Summer Period; provided, however, for the first contact year, the denominator shall be the number of hours between Phase 1A COD and the end of the Summer Period, and provided further that the Conversion Period shall be excluded from any calculation of Summer Availability.

Examples of Summer Availability in a sentence

  • Within fifteen (15) Days following the end of each Summer Period during the Term, Seller shall provide the Department with a statement setting forth the Summer Availability achieved by the Facility during the immediately preceding Summer Period.

  • Subject to Section 8.09 herein, Tenaska shall make payment of such Summer Availability Adjustment by offsetting all amounts payable by PECO to Tenaska during subsequent Months until the amount offset equals the Summer Availability Adjustment but not to exceed the Tier 1 Availability Adjustment.
