Substantially Perform definition
Substantially Perform means substantial performance as set out in the Construction Act, R.S.O. 1990, c. 30 and “Substantially Performed” shall have a meaning consistent therewith
Substantially Perform means: a level of compliance with the terms of the Agreement that ensures the essential requirements of the Agreement are fulfilled. Only substantial non-performance shall constitute a breach of the Agreement. Substantial non-performance occurs when there are violations of the Agreement that are significant, repeated and/or systemic in nature.
