Substantial conformity definition

Substantial conformity means the revisions to approved applications that do not significantly alter the historic character or alter additional physical elements of the structure as approved in the original application.
Substantial conformity means there is no variation from the preliminary plan, other than minor changes in the size of lots, location of lot lines, easements or streets. “Substantial conformity” does not include any change in types or numbers of land uses, any variance in residential density, any change in location of a public right-of-way in excess of five feet (5') or any variation of a dimen- sional limitation in excess of five percent (5%).
Substantial conformity means a transaction with a purchase price no less than ninety seven percent (97%) of the purchase price in the Proposed Transfer Notice, a close of escrow of no later than thirty (30) days after the outside closing date specified in the Proposed Transfer Notice and including every other material term of the Proposed Transfer set forth in the Proposed Transfer Notice (including material terms contained in the proposed buyer’s written offer and any other agreement attached to the Proposed Transfer Notice).

Substantial conformity means a close of escrow within thirty (30) days of the Outside Closing Date, at a cash sales price of no less than ninety-five percent (95%) of the price set forth in the Proposed Transfer Notice, and on other terms not substantially and materially more favorable than those set forth in the Proposed Transfer Notice. If the Proposed Transfer is not consummated, and/or the terms thereof are changed so that the Proposed Transfer is not in Substantial Conformity with the terms described in the Proposed Transfer Notice, within the time periods set forth herein, then the Proposed Transfer Property shall again be subject to Pulte’s Right of First Refusal (to the extent that Right of First Refusal does not expire or otherwise terminate, or has not expired or otherwise terminated, pursuant to any other provision of this Agreement).
