Subscriber’s Obligations. It is the responsibility of the Subscriber to purchase computer hardware and software and/or make modifications to their existing equipment that are necessary for access to the Database. The Subscriber is responsible for ensuring that unauthorized personnel do not use the Subscriber’s computer. Information accessed from the Database is for the use of the Subscriber.

The subscriber shall also refrain from submitting to GlobalSign or any GlobalSign CA directory any material that contains statements that violate any law or the rights of any party.

Subscriber’s Obligations. 3.1 Compliance with Laws and Rules and Regulations. Subscriber agrees that Subscriber will comply at all times with all applicable laws and regulations and Netgateway's general rules and regulations relating to its provision of eCommerce Services, currently included herein as Section 10, which may be updated and provided by Netgateway to Subscriber from time to time ("Rules and Regulations"). Subscriber acknowledges that Netgateway exercises no control whatsoever over the content contained in or passing through the Subscriber's web site, storefront or mall ("ECommerce Centers"), and that it is the sole responsibility of Subscriber to ensure that the information it transmits and receives complies with all applicable laws and regulations.

It is the responsibility of the Subscriber to purchase the computer hardware and software and/or make modifications to their existing equipment, which are necessary to effect access to the system. • The Subscriber is responsible for ensuring that its location and/or computers are not used by unauthorized personnel to access information from the system. Unauthorized personnel, for the purpose of this Agreement, shall be any person or entity other than the Subscriber or its employees. • Information accessed from the system is for the use of the Subscriber in the ordinary course of its business. • The Subscriber is responsible for ensuring that the use of the system by its employees is conducted in a proper and legal manner. If the Subscriber or one of its employees is convicted of a crime, including, but not limited to, a violation of the Virginia Computer Crimes Act (§ 18.2-152.1 of the Code of Virginia), arising out of the use of the system, such conviction shall constitute a material breach of this Agreement, and the Clerk’s office shall have the right to terminate this Agreement immediately. Nothing contained herein shall be construed as prohibiting the Clerk’s office from pursuing any other remedy available to it for such breach.
Subscriber’s Obligations. In consideration for the Services, Subscriber agrees to pay the monthly Service Rates set out in Paragraph 3 to the Society on a timely basis. Subscriber agrees that he/she is the only person authorized to use the Services Subscriber will abide by the Society’s rules and regulations for the use of the Services which are incorporated in this Agreement by reference. Society will provide a copy of the rules and regulations to Subscriber upon entering this Agreement. It shall be Subscriber’s duty and responsibility to keep the Society advised of Subscriber’s current location and where and how he or she may be contacted in order for the Society to notify Subscriber of messages taken by the Society on Subscriber’s behalf. Subscriber’s failure to keep the Society advised of his/her practice hours, whereabouts and return times when forwarding phones will result in a per incident charge of $10.00 in addition to the monthly Service Rates. The Society will make reasonable efforts to notify Subscriber of his/her messages. Subscriber is solely responsible for notifying his/her patients or clients of the availability of the Services, including the Service telephone number. Subscriber agrees to indemnify, defend and hold the Society harmless for any consequences, claims or liability of any kind or nature whatsoever in the event the Society cannot locate Subscriber after making reasonable efforts or Subscriber has not made the Service telephone number available to Subscriber’s patients.

Subscriber’s Obligations. By signing this Agreement, SUBSCRIBER will take all necessary precautions to maintain the security and integrity of the CLERK’S computer system. Specifically, SUBSCRIBER will educate users of their responsibility to keep access identification and password confidential, and to use the system only to fulfill their work duties on behalf of SUBSCRIBER. SUBSCRIBER is responsible for ensuring that its location or its terminal is not used by Unauthorized Users to access information from the Clerk’s subscriber site. Information accessed from subscriber site is for the use of SUBSCRIBER in the ordinary course of its business. The information is not intended or permitted to be commercially resold as the official governmental record required by law. In the event of a breach of this paragraph, CLERK is entitled to seek injunctive relief restraining SUBSCRIBER from accessing information from the subscriber site, and/or terminate this Agreement in accordance with Article 12 herein. This shall not be construed as prohibiting the CLERK from pursuing any other remedy available at law or equity for such breach. SUBSCRIBER is responsible for ensuring that use of the Clerk’s subscriber site by its Authorized Users is conducted in a proper and legal manner. If SUBSCRIBER is charged with a crime arising out of use of the subscriber site, CLERK shall have the right to terminate this Agreement immediately. This shall not be construed as prohibiting CLERK from pursuing any other remedy available at law or equity for such a breach. THE PUBLIC INFORMATION ON THE SUBSCRIBER SITE IS PROVIDED SUBJECT TO THE LAWS OF THE STATE OF FLORIDA.
