Subject Software definition

Subject Software means the Original Software, Modifications, or any respective parts thereof.
Subject Software means the computer software developed by Creative employees and by third-party developers under contracts between Creative and such developers and delivered to uBID prior to the Effective Date relating to the online auctioning of computer, electronics and home and leisure products, including, without limitation, all user manuals, reference manuals and other documentation and materials relating thereto; any derivative works, fixes, upgrades, updates, enhancements or new versions thereof, in existence as of the Effective Date.
Subject Software shall have the meaning set forth in Section 2.1(h).

  • All sublicenses to the Subject Software properly granted by the breaching Recipient shall survive any such termination of this Agreement.

  • Upon termination, a Recipient agrees to immediately cease use and distribution of the Subject Software.

  • This Agreement constitutes the entire understanding and agreement of the parties relating to release of the Subject Software and may not be superseded, modified or amended except by further written agreement duly executed by the parties.

  • A Recipient may create a Larger Work by combining Subject Software with separate software not governed by the terms of this agreement and distribute the Larger Work as a single product.

  • In such case, the Recipient must make sure Subject Software, or portions thereof, included in the Larger Work is subject to this Agreement.

  • Once a copyright notice has been added to the Subject Software, a Recipient may not remove it without the express permission of the Contributor who added the notice.

Subject Software means uBid's proprietary software, in object code ---------------- and source code form, relating to the online auctioning of computer, electronic, houseware, sports, jewelry, gifts and other products and services, used by uBid now and in the future on uBid's own website in the United States for which uBid grants LibertyOne a license pursuant to this Agreement and the Updates therefor.

Related to Subject Software

  • Font Software means software or instructions which, when used on an appropriate device or devices, generates typeface and typographic designs and ornaments. Font Software shall include all Subsets and bitmap representations of typeface and typographic designs and ornaments created by or derived from the Font Software. Font Software includes upgrades or updates (each of which may be provided to you by Monotype in its sole discretion), related files, permitted modifications, permitted copies, and related documentation.

  • Seller Software means Software owned by or developed by or for Seller for use in or in connection with the Business.
