Sub-Undertenant definition
Sub-Undertenant means any tenant under a Sub-Underlease]. [Subject to paragraph 2.2 of this Part of the Schedule, the] [The] Tenant may, with the Landlord's consent, sub-let the whole of the Premises [or the whole of a Permitted Part] by an Approved Sub-lease to an Approved Sub-tenant. [The grant of a Sub-lease [or a Sub-Underlease] must not result in the Premises being divided into more than [Insert number] self-contained units of occupation, taking into account any existing Sub-leases[ or Sub-Underleases].] The Tenant must ensure the Sub-tenant complies with the terms of its Sub-lease[ and any Sub-Undertenant complies with the terms of its Sub-Underlease]. The Tenant must not reduce, defer, accelerate or commute any rent payable under any Sub-lease. On any review of the rent payable under any Sub-lease, the Tenant must: review the rent payable under the Sub-lease in compliance with its terms; not agree the reviewed rent (or the appointment of any third party to decide it) without the Landlord's approval; include in the Tenant's representations to any third party any representations that the Landlord may require; and notify the Landlord what the reviewed rent is within two weeks of its agreement or resolution by a third party. The Tenant must not vary the terms or accept any renunciation of any Sub-lease without the Landlord's approval. Base Rent and Turnover Rent This Part of the Schedule uses the following definitions:
Sub-Undertenant means any tenant under a Sub-Underlease].
Sub-Undertenant means any tenant under a Sub-underlease].
Examples of Sub-Undertenant in a sentence
The Landlord and the Tenant permit the Undertenant to grant the Sub-Underlease to the Sub-Undertenant on the terms of this Licence.
The Undertenant must not permit the Sub-Undertenant to occupy the Sub-Underlet Premises before the Underletting Date.
The Guarantor, as primary obligor, guarantees to the Landlord and separately to the Tenant that: the Sub-Undertenant will comply with all of the Sub-Undertenant’s Obligations and will not breach any of the Tenant’s Obligations or the Undertenant’s Obligations (excluding payment of rents and other sums).
