sub-soil rights definition
sub-soil rights means any rights to mines and minerals found or likely to be found, whether on surface or underground of any land;
sub-soil rights means all the ‘sub soil rights’ referred to in the Governor General’s Proclamation dated thirty first day of December of the year one thousand nine hundred and fifty six, as therein described, stretching from point “X” to point “Y and marked dotted in Red colour on Location Plan indicated as Property Drawing number sixty five underscore two thousand and four, having a global length of approximately seven thousand one hundred and seventy metres; a copy of the Proclamation is annexed to the Deed of Grant as document ”BB”. The Government or its predecessors in title utilised the above mentioned ‘sub soil rights’ in order to construct underground fuel storage facilities and tunnels and other ancillary works, known as “Has- Saptan/Corradino Fuel Storage Complex” without number in the limits of Paola, Tarxien, Santa Lucia, Birzebbugia, Gudja, Ghaxaq and Marsaxlokk and accessible mainly from the Ras Hanzir property described under item letter ‘m’ in the Deed of Grant (namely, the property which is described in paragraph (m) in the definition of the term Properties on this deed) and from other points variously referred to as Access Points above, and from the property shown on the said Plan PD 65_2004_1 as described in the Deed of Grant under item letter “d” describing the immovables granted on emphyteusis (namely, the property which is described in paragraph (d) in the definition of the term Properties on this deed).
