SUB-PRECINCT definition
SUB-PRECINCT means the Sibaya Sub-Precinct 1A, as defined in the ASSOCIATION’S Memorandum of Incorporation;
SUB-PRECINCT means the Immovable Property described as Portions 173- 175 (of 140) of ERF 2406 UMHLANGA ROCKS and proposed Portions 176- 284 (of 175) of ERF 2406 UMHLANGA ROCKS, in extent approximately 10 hectares; as shown on the plan, and any other property that may be included in the sub-precinct as contemplated in Article 25 hereof, including any subdivision of the aforesaid properties but excluding any property which is owned by eThekwini Municipality (or which otherwise constitutes a public road);

The PURCHASER acknowledges that should the Local Authority or any other service provider not have the means, or be unwilling, or agree to delegate the obligation to the ASSOCIATION, to maintain or to provide municipal services within the SUB-PRECINCT, the ASSOCIATION may, if the ASSOCIATION in their sole discretion deem it appropriate, take over the responsibility for providing and maintaining such services and/or enhanced services.
