State Data Storage: Contractor agrees that all State Data will be stored and maintained in data centers in the United States.
Upon Purchaser’s direction to Contractor to remove the Satellite from Storage, Contractor shall, (i) conduct the post-storage verification tests as set forth in Exhibit D, SATMEX 8 Satellite Test Plan, (ii) refurbish and retest the refurbishment as needed due to Storage and (iii) take appropriate corrective measures pursuant to Article 31.

During such period in Storage, Contractor shall be paid the Space Segment Acceptance Payment and Orbital Performance Incentives as if the Satellite is a Satisfactorily Operating Satellite (i.e., 100% of applicable incentives based on the applicable Daily Rate).
Hazardous Material Storage: Contractor shall provide the City of San Diego’s Real Estate Assets Department with a list of any and all hazardous materials that may be stored, treated or disposed of on Site during the Term of this Agreement.
Upon Purchaser direction to Contractor to remove the Satellite from Storage, Contractor shall conduct the post-storage verification tests as set forth in Section 7 (Storage and Post-Storage Test) of Exhibit D, Satellite Test Plan, and ship the Satellite to the designated Launch Site (or to such other location as Purchaser may direct).
Storage: Contractor will be responsible for providing secure storage of Vessels, Structures and/or personal belongings after removal as indicated in the Work Order Contract.
Repairs and modifications required by the FAA or desired by Southwest shall be performed by the Storage Contractor or Southwest and shall be at the sole cost and expense of Southwest.
If Purchaser places a Satellite in Orbital Storage, Contractor shall continue to earn Orbital Performance Incentives at the same daily rate as Contractor was earning prior to the Satellite being placed in Orbital Storage for the balance of the Orbital Performance Incentive Period.
