The amount of the DBM’s or MCO’s payment responsibility shall be contained in the State’s Decision.
The parties acknowledge, thereafter, any operations of the Lessee on FirstNet Spectrum will be pursuant to terms and conditions established by the implementation of the State’s Decision.
This section does not relieve the Lessee of any obligation it may have following the date of the State’s Decision to pay any fees associated with use of the nationwide public safety broadband network, pursuant to sections 6208 and 6302 of the Tax Relief Act.
To that end, as set forth below, FirstNet and the Lessee intend to make good faith efforts to minimize any disruptions in the availability of Lessee’s wireless communications services to Public Safety Entities, and to ensure the interests of the State of New Mexico are included in any such good faith efforts that follow the date of the State’s Decision.
If a party fails to pay the State for the party’s payment responsibility as described in this Section, Section 2.9.8.5.8, within thirty (30) calendar days of the date of the State’s Decision, the State may deduct amounts of the payment responsibility from any current or future amount owed the party by the State.
If LEP disagrees with the State’s Decision or if the State’s Decision is not rendered within sixty (60) days of written request for such State’s Decision, LEP or the Project SPE shall have the right to administrative review by the Commissioner pursuant by La. R.S. 39:1685.
If the Commissioner upholds the State’s Decision after Administrative review, LEP shall have the right to appeal the adverse decision of the Commissioner to the Nineteenth Judicial District Court pursuant to LA.
