An employee laid off or about to be laid off may open any employment register for which he/she is eligible for the purpose of establishing qualifications for any State position.
Upon the expiration of the above stated leave periods, the employee shall be terminated, and has no further rights to the State position.

The provisions of this Article will apply only if the employee in the position to be assumed requests transfer to another State position.
Every permanent employee holding a position in the competitive class and appointed to a State position from an open competitive eligible list shall be granted a leave of absence from their position for the duration of their probationary term.
The State will provide to Designated Employees the option of transferring to a State position performing work outside of the scope of this Agreement.
