Spoils definition

Spoils means material removed from subsurface excavations and brought to the land surface for storage or disposal.
Spoils means the excavated soils from beneath any Project Facility, transmission tower supports or other Tenant’s property that were previously secured in the underlying land of the Leased Property, but does not include any “construction and demolition debris” as such terms is defined in 6 NYCRR Part 360 (b)(61).

  • Notwithstanding any other provision of this Agreement, in the event that it becomes unlawful for any Lender or its Applicable Lending Office to honor its obligation to make or maintain Eurodollar Loans hereunder, then such Lender shall promptly notify the Borrower and the Agent thereof and such Lender's obligation to make Eurodollar Loans shall be suspended until such time as such Lender may again make and maintain Eurodollar Loans (in which case the provisions of Section 5.04 shall be applicable).

  • Owner shall have the right, but not the obligation, to reject Supplier’s proposed use or reuse of uncontaminated Excess Spoils.

  • Spoils deposited off of the homesite in Mountainside Village shall become the property of Developer.

  • Supplier shall not transport Excess Spoils across state lines without express written permission from Owner.

  • Notwithstanding the language in this subsection, Supplier may use or reuse uncontaminated Excess Spoils to the extent allowed by law, but shall assume all risk or liability related to such activity.

  • CITY agrees to pay to VENDOR the following unit price for Transportation of Spoils for Formal Bid – FB210056 [Commodity Code Number 96239], for the Public Works & Utilities Department / Water Distribution Division as shown below as compensation as per the bid, plans, specifications, addenda and VENDOR’s bid of March 12, 2021, and as approved by the City Council on March 16, 2021.
