Specialty Installation definition

Specialty Installation means any Alteration, fixture or equipment made or installed by Tenant or Tenant’s Agents that is intended specifically for the use of Tenant or Tenant’s operations in the Premises and is not readily marketable or reusable by another office, laboratory, R&D, or general use tenant in the Premises and specifically shall include items which require special governmental permits, approvals, or consents for the installation or removal of same.
Specialty Installation means any Alteration, fixture or equipment made or installed by Tenant or Tenant’s Agents that is intended specifically for the use of Tenant or Tenant’s operations in the Premises and is not readily marketable or reusable by another office, laboratory, R&D, biologics production, or general use tenant in the Project and specifically shall include items which require special governmental permits, approvals, or consents for installation or removal (other than normal building permits). Specialty Installations shall not include construction of office and laboratory space in a quality and in a manner consistent with the office and laboratory space in any Premises Building as of the Effective Date. Except for any Specialty Installation as to which Landlord has given Tenant notice at the time of installation that such Specialty Installation must be removed at the expiration or earlier termination of this Lease as provided above, Tenant shall have no obligation to remove any Major Alterations (including the Approved Exterior Improvements) or Minor Alterations. In connection with the Initial Tenant Improvements, any Major Alterations or any other alterations, improvements, additions which are not Major Alterations (“Minor Alterations”; Major Alterations and Minor Alterations, collectively, “Alterations”) to be made by Tenant, Tenant agrees to obtain and/or cause its contractor and subcontractors to obtain, prior to the commencement of any work the insurance set forth in Section 8.1(d). Prior to commencement of the work, Tenant will provide Landlord with certificates of insurance evidencing such insurance coverages. All Alterations will comply with all Applicable Laws (specifically including but not limited to all Permits) and with all plans, specifications, and drawings relating thereto, and shall be performed in a good and workmanlike manner, using building standard materials that are substantially consistent with Class A office/research park standards in the Market Area. Within sixty (60) calendar days after substantial completion of any Major Alterations, Tenant shall provide Landlord with “as-built” plans showing the Major Alterations. Notwithstanding the foregoing, during the Term, Tenant shall give notice to Landlord of any Minor Alterations and a copy of any plans and specifications therefor. Examples of Specialty Installation in a sentence

  • Any such Slab Removal Work shall be deemed a Material Alteration and a Specialty Installation hereunder.

  • If Landlord informs Tenant in the notice indicated in the immediately preceding sentence that an item is not a Specialty Installation, then such item shall be deemed not to be a Specialty Installation hereunder and removal thereof may not subsequently be required by Landlord unless such Specialty Installation is materially altered following Landlord’s initial notice to Tenant.

  • Notwithstanding the foregoing, the Skylight (as defined in Exhibit C) as depicted (in all material respects) on the Layout Plan shall not constitute a Specialty Installation and Tenant shall have no responsibility to remove the Skylight at the end of the Term, but shall be required to deliver it at the end of the Term in good condition, reasonable wear and tear and casualty excepted.

  • The Slab Cut (as defined in Exhibit C), the Stairway/Lift (as defined in Exhibit C) shall not constitute a Specialty Installation (but all other slab cuts (including, without limitation, slab cuts required for any internal staircases between the office floors) shall be deemed to be Specialty Installations).

  • Any dispute between Landlord and Tenant as to whether an Alteration or installation constitutes a Specialty Installation shall be resolved by arbitration in accordance with the provisions of Article 34 hereof.

  • If, at the time that Tenant requests Landlord’s consent to the performance of any Alteration in accordance with the terms of this Lease, Tenant specifically inquires whether any part of such Alteration is a Specialty Installation, then Landlord shall inform Tenant along with Landlord’s response to Tenant’s consent request, whether any aspect of Tenant’s Alteration is a Specialty Installation.
