This Agreement amends and supersedes in its entirety that certain joint exercise of powers agreement, as amended, that was entered into as of March 20, 1990 (the “SMWA JPA”) to form the SMWA.
SMWA will retain sole responsibility for provision of such notice to SMWA customers.
GENERAL Based upon careful consideration of the fundamental assumptions, review of the available options for a groundwater management governance structure, discussion with engineering and other technical consultants and guidance provided by legal counsel, the SMWA Sacramento Metropolitan Water Authority Groundwater Committee and the Sacramento Water Forum Groundwater Negotiation Team make the following recommendations.
All Existing SMWA Customers, whether located "inside city" or "outside city", shall be subject to City utility taxes on their retail water service in accordance with MMC 5.20.060, as the same now exists or may be amended in the future.
The Regional Authority is hereby created pursuant to the JPA Act and this Agreement, reflecting the revisions of the SMWA JPA.
The Closing of the purchase and sale of the Property as addressed in this Agreement is expressly contingent upon prior receipt of all applicable approvals required by the NSCCWSP and the CWSPI to include the current SMWA retail water service area within the City’s retail water service area.
Upon the Closing, all Existing SMWA Customers shall be customers of the City of Monroe water utility and shall thereafter have all rights and obligations established by applicable state and local regulations.
This amendment shall not affect any contracts entered into by SMWA, except for the change of name from SMWA to Regional Authority.
In accordance with applicable state and local regulations, Existing SMWA Customers shall after the date of Closing be charged rates for water service supplied by Purchaser as either "inside city" or "outside city" depending on the geographic location of the property and the City's corporate boundary.
This Agreement changes the name of the Sacramento Metropolitan Water Authority (“SMWA”) to the Regional Water Authority (the “Regional Authority”), and supersedes the agreement under which SMWA was formed and operated.
