SKS Competitor definition
SKS Competitor means any Third Party engaged in the business of developing sustained release drug formulations.

Alcon may assign this agreement without such consent to an Affiliate or in connection with a merger, consolidation, change in control, transfer or sale of all or substantially all of the assets or business to which this Agreement relates; provided that notwithstanding the foregoing, in no event may Alcon assign this agreement to an SKS Competitor without SKS’s prior written consent.
