The SJDA’s decision regarding any Bidder's eligibility or otherwise shall be final and binding and the SJDA and/or any of agencies/ advisors would be under no obligation and/ or responsibility to inform any Bidder of the grounds of such decision / rejection.
After selection of the Preferred Bidder, a Letter of Award (the “LoA”) shall be issued, in duplicate, by SJDA to the Preferred Bidder and the Bidder shall, within 15 (fifteen) days of the receipt of the LoA, sign and return the duplicate copy of the LoA in acknowledgement thereof along with the Upfront Premium Cum Reimbursement of Project Development Expenses.
Annual Concession Fee for next Year shall require to be covered through Bank Guarantee in favour of SJDA and the same shall be submitted upon payment of the respective Annual Concession Fee.
If a state or local emergency, or other event solely out of SJDA and WBP’s control, limits the SJDA and WBP’s ability to fulfil its obligations as outlined in paragraph 3 above or if the public is unable to view the Sponsor’s dashers or participate in ice skating this season, the parties shall meet and confer on alternative arrangements for the dashers or replacement obligations.

As per the terms of the appointment, JLL has been mandated to prepare Project Inception Report including Bidding structure, Request for Proposal document including draft Concession Agreement for the purpose of this Project, assist SJDA for managing the competitive bidding process in transparent manner and signing of the Concession Agreement with the selected bidder of the Project.
In addition, the proposed work plan and investment plan as per Format 9 of the Technical Proposal shall be evaluated in details by the experts of the SJDA.
Upon receipt of such notices, the Developer shall communicate the SJDA describing their comment on such Notice and intimate action plan for compliance of the suggestions/ recommendations of the SJDA and take further steps, as necessary, for implementing the action plan in consultation with the SJDA.
The SJDA shall have the right to reject any/ all proposals on the ground of non-availability of sufficient/ desired information of the Format 9 and on the ground of lack of accuracy/ feasibility of the said work plan and investment projection.
