The PARTNER has submitted project(s) for testing, certification and/or other services to be performed by SIQ.
If the PARTNER breaches its obligation to use access to the portal and obligation to use the portal only for the purpose stipulated in Section 1 or tries to breach such obligation and/or if it beaches its obligation not to disclose or tries to disclose confidential information, SIQ shall immediately prevent the PARTNER’s access to the portal and the use of the portal and shall claim compensation for any damage arising from such a breach.
SIQ grants the Partner a non-exclusive and non-assignable right of use to the Products and associated functionalities it has developed and made available to the Partner in accordance with, and subject to the terms and conditions of, the Contract.

During the duration of the Contract, the Partner and companies affiliated with it are prohibited from, directly or indirectly via contractual relationships with SIQ competitors, advertise, market or resell any products within the Distribution and Resale Territory that are identical or similar to SIQ's Products (see individual agreement on the Partner Offer and the associated appendices) (“Competing Business”).
During its review of AP SI.Q, DOE will consider: 1) the procedure it would follow to conduct a systematic and uniform verification - all areas of a code analyzed at a consistent level, 2) the process it would follow to ensure correct implementation of algorithms, and 3) the process it would follow for the full disclosure of calculations and results.
Partner shall not assign any of its rights under the Contract, except with the prior written consent of SIQ.
If the Partner desires to develop its own platform during the Term, SIQ shall grant the Partner access to the API and all associated important documentation.
Until proven otherwise, all revenues generated from such Competing Business shall be deemed as profits lost by SIQ and payable by Partner to SIQ as direct damages.
