Similars definition

Similars means an Image that is substantially similar to any Accepted Image and which may reasonably cause an industry professional viewing the image to believe it is the same or substantially the same image, whether in color or black and white. Images shall not be considered Similars based only on their subject matter.

  • Images that are not Similars and not selected by WIN may be marketed, distributed, sold or licensed as stock images, either directly by Talent or through a third party, or used personally by Talent and in portfolios.

  • On a non-exclusive basis, you may use Accepted Content and any Similars for promoting or documenting you and your work, provided that these uses do not compete with or limit the rights granted to Getty Images under the Agreement.

  • WIN grants to Talent the non-exclusive right to use any Image or Similars for personal, non- commercial purposes, such as portfolio, exhibition, competition, single photographer publication, personal website, self- promotion and limited edition fine art print sales through galleries.

  • The SFU Library may terminate the term of this Agreement for any annual Support Offering other than hosting services at any time and for any or no reason upon the provision of sixty (60) days written notice to the Customer, in which case the SFU Library shall provide the Customer with a pro rata refund of the applicable Support Fees for the remainder of the months in the then-current term of the Agreement.
