  • Provided further, notwithstanding a forfeiture of the Show Home Performance Fee by the Builder, nothing herein shall preclude the City from exercising any other right, pursuing any other remedy or maintaining any action to which the City may otherwise be entitled either at law or in equity, with respect to the enforcement of the terms and conditions of this Agreement.
