Short Batch definition

Short Batch means a batch of API produced by Novasep that has a yield that is lower than the minimum expected batch size, where such expected batch size is determined by dividing the amount of Initial Materials that were consumed in the manufacture of such batch by the then-applicable upper bound of the Target Consumption Range (e.
Short Batch means a Batch of API but one undergoing less than the number of IMAC cycles designated in a Firm Order but in no case less than [***]. References to Batch herein also apply to Short Batches unless specifically differentiated.

Examples of Short Batch in a sentence

  • The Parties will determine such amount of Initial Materials by (i) multiplying the then-applicable upper bound of the Target Consumption Range (e.g., [c.i.] Initial Materials per kg API as of the Effective Date) by the amount of API actually produced in such Short Batch and (ii) subtracting the product so obtained from the amount of Initial Materials that were actually consumed in the manufacture of such Short Batch.

  • Further, in the event of any Short Batch, Novasep shall reimburse Inspire in accordance with the second preceding sentence for the Inspire Materials that were consumed in the manufacture of such Short Batch but which did not result in production of API that is not Nonconforming API.
