The District is, and will be on the Closing Date, a unified school district duly organized and validly existing under the laws of the State of California, with the power to issue the Bonds pursuant to the Bond Law with respect to SFID 3, to adopt the Bond Resolution and to enter into this Purchase Agreement and the Continuing Disclosure Certificate (as defined in paragraph (i) below).
The Series 2020 Bonds are secured by the levy of ad valorem property taxes on all taxable property in the territory of SFID No. 1, which taxes are unlimited as to rate and amount (except with respect to certain personal property that is taxable at limited rates).
SFID 3 was duly formed in accordance with all legal requirements and is on this date and will be on the Closing Date validly existing under the laws of the State of California.
The Bonds are issued under the provisions of a resolution adopted by the Board of Trustees of the District on April 22, 2025 (the “Bond Resolution”) and applicable provisions of the California Government Code defined more particularly as the “Bond Law” in the Bond Resolution (the “Bond Law”), all for the purpose of financing educational projects in SFID 3, as more particularly described in the Bond Resolution and the Preliminary Official Statement (as defined herein).
This Series 2020 Bond is issued under the authority of and pursuant to the Constitution and statutes of the State of California, and the proceedings of the District duly adopted and taken, a vote and assent of more than fifty-five percent of all the qualified electors of SFID No. 1 voting at an election duly called and held for that purpose on November 7, 2006 (collectively, the “Law”), and pursuant to the Paying Agent Agreement.
MUSD will assume responsibility for ongoing debt administration, future issuance, and refinance of all outstanding SFID 2 GO Bonds.
To the extent funding and approvals are available, SMMUSD will continue to progress without unneeded delay remaining projects in the Measure M (SFID 2) bond, including tying ▇▇▇▇▇▇▇ Elementary into the new sewer system.
The Bonds are secured by the levy and collection of voter-approved ad valorem taxes on all taxable property within SFID 3, unlimited as to rate or amount.
SMUSD will assume responsibility for ongoing debt administration, future issuance, and refinance of all outstanding GO Bonds of SMMUSD, except for outstanding SFID 2 bonds.
SMUSD taxpayers will continue to repay outstanding GO Bonds and future issuances of SFID 1.
