Servient Owners definition

Servient Owners means those owners of the servient tenements in respect of the Easements who are subject to the burden of same, provided however, that for the purposes of giving and receiving notices, and for the purposes of carrying out any Work or repairing and/or restoring any damage or alterations, all as contemplated in Article 8.00 hereof, the term “Servient Owners” shall include, where applicable, the condominium corporation (for and on behalf of the unit owners thereof) created over all or any portion of the aforesaid servient tenement;

  • Where an easement is granted by a servient tenement owner ("Servient Owner") to an adjacent (or nearby) dominant tenement owner ("Dominant Owner"), typically, the Servient Owner undertakes to the Dominant Owner to permit the Dominant Owner to make certain specified usage of the Servient Owner's land.

  • The Dominant Owner covenants and agrees, at the Dominant Owner's expense, to promptly and diligently repair and restore, to the condition prior to the damage, all damage to the Servient Owner's Property and personal property caused by the Dominant Owner or anyone authorized by the Dominant Owner or this Agreement.
