Examples of Services Defect in a sentence
During the Subscription Period, at no additional cost to Customer and as Customer's sole and exclusive remedy for failure to meet this limited warranty, PPRA will correct any material fault in the PPRA software used to provide the Services ("Defect") in accordance with the Support guidelines, provided that Customer promptly notifies PPRA in writing upon discovery of any such Defect and PPRA's investigation discloses that such Defect exists.
SPINWELL-GLU may, upon the request of Customer, provide support in respectof any problem that is not a Hosted Services Defect, but may charge Professional Service Charges in respect of such support.
Ownership of the Services Defect and/or Gap IT Defect will revolve around and be driven by the Gap Covered Location’s needs and will minimize transfers to multiple parties.
The communication and reporting will commence upon identification of a Gap IT Defect or Services Defect, through Resolution, and, as necessary, through any follow-up communication and work required post-Resolution.
SPINWELL-GLU may also charge Professional ServicesCharges for all time reasonably spent and all expenses reasonably incurred by it in order to verify that a problem reported to it by Customer is not a Hosted Services Defect.
In particular, the said warranties shall not apply to the extent that any Hosted Services Defect or Software Defect arose or was exacerbated as a result of any of the matters listed in CLAUSE 7.3.1 to 7.3.4.
