Service Shortfall definition

Service Shortfall shall have the meaning set forth in Section 2.11(a).
Service Shortfall means the difference between the water and wastewater service cov-erage, quantity and quality which Customers and potential Customers would demand at the allowed tariff levels, and the level of such services which can be provided with the existing facilities.
Service Shortfall means that there has been a failure to provide any of the Services in accordance with the relevant Services Table (provided that if a Service Shortfall has arisen because of the simultaneous occurrence of a number of events requiring a response under the same performance standard as described in the Services Table, then all of those events shall be deemed to amount to a single Service Shortfall and not separate Service Shortfalls); Services Contract means each contract entered into between the Operator and a Services Provider for the provision of the Services;

  • For purposes of this Section 1.5(c), a "Significant Service Shortfall" shall be deemed to have occurred if the timing or quality of performance of Corporate Services provided by PROVIDING PARTY hereunder falls below the standard required by Section 1.5(a) hereof; provided that PROVIDING PARTY's obligations under this Agreement shall be relieved to the extent, and for the duration of, any force majeure event as set forth in Article V.

  • Termination or expiration of this Agreement, or suspension or discontinuance of the Services provided under this Agreement, shall not affect any obligations or liability of either Party that accrued prior to the effective date of termination, including any damages or other liability that may arise under or as a result of a Significant Service Shortfall.
