If the unauthorized acquisition, access, use or disclosure of CE’s PHI involves only Secured PHI, BA shall notify CE within 10 days of discovering the Breach but is not required to notify CE of the names of the individuals affected.
Notify the designated Privacy Official of the Covered Entity of any use or disclosure of PHI by Business Associate not permitted by this Agreement, any Security Incident involving electronic PHI, and any Breach of Unsecured or Secured PHI as required at 45 CFR§ 164.410 within 12 hours.
