Section 871(m) Event definition
Section 871(m) Event means the Issuer is (or, in the determination of the Issuer, Swap Counterparty or Calculation Agent, the Issuer is reasonably expected to become) subject to any withholding on any payment to it in respect of the Assets and/or the Swap Agreement pursuant to Section 871(m) of the Code.
Section 871(m) Event means that the Issuer and/or any Hedging Party is (or, in the determination of the Calculation Agent, there is a reasonable likelihood that, within the next 30 Adjustment Business Days, the Issuer and/or any Hedging Party will become) subject to any withholding or reporting obligations pursuant to Section 871(m) of the U.S. Internal Revenue Code of 1986, as amended, with respect to the Notes and/or any Hedging Positions.
