Section 203(a)(3)(B) Service definition

Section 203(a)(3)(B) Service means the employment of an Employee by the Employer or an Affiliated Employer during a calendar month, subsequent to the time the payment of the Participant’s Pension commenced or would have commenced if the Employee had not remained in or returned to employment during such month, if the Employee is credited with at least 40 Hours of Service during such calendar month.
Section 203(a)(3)(B) Service means the employment of an Employee by the Employer or an Affiliated Employer during a calendar month,
Section 203(a)(3)(B) Service means the employment of an Employee, subsequent to the time the payment of benefits commenced or would have commenced if the Employee had not remained in or returned to employment during a calendar month, if the Employee completes in such month 40 or more Hours of Service for an employer which maintains the Plan as of the time that the payment of benefits commenced or would have commenced if the Employee had not remained in or returned to employment. In the case of an Employee for whom records of Hours of Service are not maintained, an Employee who receives payment for any such Hours of Service performed on each of 8 or more days in such month shall also be treated as employed in Section 203(a)(3)(B) Service.

  • As elected by the Employer in the Adoption Agreement, normal or early retirement benefits will be suspended for each calendar month during which the Employee completes at least 40 Hours of Service with the Employer as defined in section 203(a)(3)(B) of the Employee Retirement Income Security Act of 1974, as amended ("Section 203(a)(3)B Service").
