If this Agreement is terminated by SCAG, as provided herein, SCAG’s only obligation shall be the payment of fees and expenses incurred prior to the termination date, in accordance with the cost provisions of this Agreement.

For breach or violation of this warranty, SCAG has the right in its sole discretion to terminate this Agreement with its only obligation to pay for the value of the work actually performed, or to deduct from the Agreement price, or otherwise recover, the full amount of such commission, percentage, brokerage, or contingency fee.
SCAG reserves the option to terminate this Agreement or to amend this Agreement to reflect any reduction in funds.
