  • The Shareholder shall within 180 days cause RTC to establish, effective as of the Closing Date, for itself and its Subsidiaries a defined contribution plan (the "RTC Savings Plan") containing a cash or deferred arrange- ment within the meaning of section 401(k) of the Code and con- taining provisions substantially similar to the ▇▇▇▇▇▇▇▇▇▇▇ Savings Plan, to the extent required pursuant to section 411(d)(6) of the Code by a transferee plan.
