Notwithstanding the notice provisions in Section 3.0, in the event Member desires to not operate any or all of it Generation Facilities after May 3, 2013, due to the impacts of the RICE Rule (including the monitoring, maintenance, and recordkeeping requirements), then the associated Exhibit B schedule(s) shall be terminated, effective May 1, 2013, by providing notice to Seminole by April 1, 2013.
A Generation Facility which was terminated for non-compliance with the RICE Rule may be reinstated under this Excess Capacity Agreement, with such reinstatement date being on the first day of the calendar month following receipt of a written certification that the Generation Facility is in compliance with the Rice RICE Rule.
If any Generation Facility is not in compliance with the RICE Rule as of May 1, 2014, or such other date pursuant to an extension authorized by EPA, or other applicable regulatory agency, (as evidenced by a written certification from Member to Seminole that the Generation Facility is in compliance with the RICE Rule requirements), the associated Exhibit B schedule(s) shall be terminated, effective immediately.
Notwithstanding the notice provisions in Section 3.0 and this Section 7.2.4, in the event the Member desires to not operate any or all of its Generation Facilities beyond May 3, 2014 due to the impacts of the RICE Rule (including the emission control requirement effective May 3, 2014), then the associated Exhibit B schedule(s) shall be terminated effective May 1, 2014, by providing notice to Seminole by May 1, 2013.
During the period May 3, 2013 through May 1, 2014, ▇▇▇▇▇▇▇▇ agrees to coordinate with Member for purposes of remaining within the allowable operating hours for emergency stationary internal combustion engines as defined in the RICE Rule.
All Generation Facilities under this Excess Capacity Agreement shall be in compliance with the RICE Rule.
