Revised Plans definition

Revised Plans means Plans that are the same as the prior Plans submission except with respect to the items that Landlord has specifically rejected in the prior Plans submission. Any failure by Tenant to submit Revised Plans within ten (10) days after receipt of Landlord’s disapproval shall be deemed a Tenant’s Delay. Once Landlord has accepted in writing Tenant’s proposed Plans, all of the following shall apply: (i) any request for modification to said accepted Plans shall be subject to Landlord’s prior written consent, (ii) any time spent by Landlord because of any such request for modification shall be deemed a Tenant’s Delay (irrespective of whether Landlord accepts said modification), (iii) any costs incurred by Landlord because of any such request for modification (irrespective of whether Landlord accepts said modification) shall be due and payable by Tenant to Landlord as Additional Rental within ten (10) days after Landlord’s written demand, and (iv) if Landlord consents to such modification, (a) any work included in said modification shall be deemed “Modification Work” and shall be performed by Landlord as part of Landlord’s Work but at Tenant’s sole cost and expense (payable by Tenant to Landlord as Additional Rental within ten (10) days after Landlord’s written demand), and (b) any additional time spent by Landlord performing Modification Work (ie. beyond what Landlord would have spent if not for the Modification Work) shall be deemed a Tenant’s Delay.

Revised Plans means all plans and specifications necessary or desirable to construct and complete any item of Extra Work.

Examples of Revised Plans in a sentence

  • Upon any disapproval, Grantee shall have ten (10) days to revise plans and specifications or proposed change ("Revised Plans") for resubmission for approval or disapproval by Triumph.

  • Triumph shall have fifteen (15) days from receipt of the Revised Plans and specifications or proposed change to notify Grantee of its approval or disapproval of Revised Plans.

  • The Revised Plans replace in full any plans and materials showing and describing the Original Proposal.

  • The Contractor shall submit to the COR, the Revised Plans and corresponding Comment Resolution Reports that document how each substantive comment was resolved.

  • If ESI is legally obligated to collect and remit, or to incur or pay, any such sales, use, excise, or other similarly assessed and administered tax, surcharge, or fee in a particular jurisdiction, such amount will be reflected on the applicable invoice or subsequently invoiced at such time as such obligation becomes due.

  • In the event that the Chargers are not willing to approve such Revised Plans, then the Chargers shall have the right to terminate this Agreement, in which event the Prior Occupancy Agreement shall be reinstated and be in full force and effect.

  • Pursuant to MPS HPCC 2.10 and HPCC2.5, the Applicant shall implement and maintain the Revised Project’s landscaping, including vegetated screening buffers, in accordance with the approved landscaping plan and corresponding landscape maintenance protocols included in the Revised Plans and Materials.
